TERMS AND CONDITIONS FOR ONLINE USERS
The Counter-Narrative Collection is an initiative that developed following a January 2011 conference of the United NAtions Counter-Terrorism Implementation Task Force Working Group on the "Use of the Internet for Terrorist Purposes." At this conference, the participants agreed to create a library of existing counter-narratives, which would focus on countering violent extremist messages. The existing counter-narrative collection was initially developed and launched by the Government of the Netherlands, was acting in cooperation with several other governments. Hedayah took ownership of the Counter-Narrative Collection in July 2015 with a mandate to identify and add new regional and global counter-narratives.
2. DEFINITIONS AND INTERPRETATION
2.1 The Counter-Narrative Collection (the "Collection") is an online library of existing narratives which focus on countering extremist messages. The Collection aim to serve as a comprehensive portal through which governments, front-line workers and civil society can access information used to counter the narratives of all forms of training and capacity-building activities in countering violant extremism in our sociaty. The Collection grants users the privilages of accessing and viewing the text, graphics, audio, design, charts, and other content (the "Collection Content") on the website solely for their personal, non-commercial use.
2.2 Access to and of the Collection by online users (each a "User" and, together, the "Users") is subject to the terms and conditions set out herein (the "Terms and Conditions").
3. GENERAL TERMS AND CONDITIONS
3.1. These Terms and Conditions form a binding contrat between the User and Hedayah. By using or accessing the Collection, a User accepts and agrees to be bound by these Terms and Conditions.
3.2. Users of the website are governed by the version of the Terms and Conditions in effect on the date in which this website is accessed by the user.
3.3. Hedayah may modify these Terms and Conditions at any time and without prior notice. To the User. It is recomended that Users review these Terms and Conditions from time to time, as continued use of this site by a User signifies acceptance of any and all changes.
3.4. The Collection Content is subject to change without notice.
3.5. By using the website, Users agree to the following personal information being stored for internal use by Hedayah:[name, title, email address and organization].
3.6. Neither Hedayah nor any third party provides any warranties or guarantees as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered in the Collection Content for any particular purpose. Users acknowledge that such information and materials may contain inaccuracies or errors and Hedayah expressly excludes liability for any such inaccuracies or errors to the fullest extent permitted by law.
3.7. From time to time, the Collection may also include links to other websites. These links are provided for Users' convenience by providing further information. The inclusion of such links does not signify that Hedayah endorses any referenced websites.
3.8. Hedayah holds no responsibility for the content of linked websites.
3.9. Hedayah holds no responsibility for, nor endorses any, comments, questions, feedback, and ideas expressed in the content of any websites to which the Collection may present links, and does not maintain any affiliation or association with the operators of any such websites.
3.10. Users may not use the Collection to:
(I)Perform any activity which is or may be, directly or indirectly, unlawful, including, but not limited to, any acts which may be deemed to be, in any way, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful or racially, ethnically or otherwise objectionable;
(II) Perform any activity which may breach a third party right;
(III) Engage in commercial activities, including but not limited to, offering for sale any products or services, soliciting for advertisers or sponsors or selling, licensing or granting public access to any materials or information displayed in the Collection; or
(IV) Share views which justify, promote, incite, or support violence to achieve any number of social, religious, or political changes.
3.11. Users are prohibited from forwarding or redirecting the Collection Content without the prior written permission of Hedayah.
4.1. Hedayah retains copyright in the website and all current and future content displayed on the website which is not owned by third parties.
4.2. Hedayah grants Users no other privilages or rights in the website or any surrent and future content displayed on the website other than the limited rights of access to and viewing of the Collection Content.
4.3. Users acknowledge that any other use of the website and Collection Content, including without limitation, reproduction, modification, distribution, transmission, republication, display, performance, translation, reverse engineering, de-compilation or disassembling, creation of derivative works, exporting, selling, licensing, renting, leasing, transferring, or otherwise transferring rights to the work, or removing any proprietary notices or labels on the work, without the prior written permission of Hedayah is strictly prohibited, such permission to be granted at the sole discretion of Hedayah on a case by case basis.
5.1. Unless expressly stated otherwise, all logos and other service marks, brandings, trademarks, page headers, custom graphics, and button icons that exist in the Collection are service marks, trademarks and/or trade dress (collectively, the "Marks") of the Collection.
5.2. Users agree not to display, use or reproduce any of the Marks in any manner without the prior written consent of Hedayah.
5.3. Without limiting the generality of the foregoing, Hedayah specifically prohibits the use of any Mark as a "hot" link to the Collection website unless the establishment of such a link is approved in advance by Hedayah in writing. Failure to obtain such approval shall entitle Hedayah to sek an injunction enjoining such use.
5.4. All other trademarks, service marks, product names, and company names or logos displayed or cited on the Collection website are the property of their reespective owners.
6. DISCLAIMER OF WARRANTIES
6.1 Users are solely at their own risk in using the Collection content. Hedayah hereby disclaims any and all representations and warranties, whether express or implied, regarding the website site, the Collection content and products and services provided by the website including any warranties of availability, non-interception, freedom from viruses, accuracy, reliability, correctness, timeliness, completeness, non-infringement, merachantability, or fitness for a particular purpose.
6.2 Users acknowledge and agree the previsions of clause 6.1 reflect a fair and reasonable allocation of risk between Hedayah and the User.
7. LIMITATION OF LIABILITY
Under no circumstances shall the Collection, its officers, directors, agents, or employees be liable to any User for any damages, claims, demands, or causes of action, whether in tort, contract or otherwise, wether direct or indirect, special, incidental, consequential, or punitive, as a result of the User's use of the site or the content, products, or services provided thereon.
As a condition of use of the Collection, to the extent permitted by law, the User agrees to indemnify and hold Hedayah and its third party providers harmless from and against any and all claims, losses, liability, costs and expenses (including but not limited to attorneys' fees) arising from the User's use of the Collection website, or from the User's violation of these Terms and Conditions.
9.1 Hedayah makes no representation or claim that any of the Collection content is deemed appropriate for viewing or may be legally accessed from within the jurisdiction in which the User resides at the time of utilizing the Collection.
9.2 Users agree to access to the Collection website at their own risk. Hedayah accepts no responsibility for any liability, wether civil or criminal, resulting from Users' access of the Collection and/or the Collection content.
10.1 Hedayah may terminate a User's access to the Collection website or discontinue or modify the Collection content at any time without prior notice to the User.
10.2 A User's continued use of the Collection website following any such modification will constitute acknowledgement of said User's acceptence of said modifications.
11. GOVERNING LAW
The Terms and Conditions of use for the Collection website are governed by, and shall be constructed in accordance with, the laws of United Arab Emirates.
